Kanesh Sundrum, is the managing partner of Kanesh Sundrum & Co. and has been actively practicing law since 1997, specializing in civil litigation related to corporate commercial matters, local authorities, and statutory bodies. With over 20 years of experience, the author is an accredited mediator and a notary public. Throughout the author’s career, he has served as legal counsel for numerous Local Authorities, providing advice and representation at all levels of courts.
His expertise covers a wide range of legal matters involving Local Authorities, such as contractual disputes; claims for breach of statutory duties; negligence claims; injunctive and declaratory reliefs both by and against Local Authorities; judicial review applications; and cases concerning town planning and planning approval under the Town and Country Planning Act 1976. In addition, the author handles cases concerning the approval of plans, earthworks, construction and enforcement under the Street, Drainage and Building Act 1974 and the Uniform Building By-Laws 1984. He is also well-versed in matters related to assessment and rates under the Local Government Act 1976.
Most recently, the author represented Majlis Bandaraya Seberang Perai in Weng Lee Granite Quarry Sdn Bhd v. Majlis Perbandaran Seberang Perai [2020] 1 CLJ 34 at the Federal Court in successfully defending the appeal relating to s. 70A of the Street, Drainage and Building Act 1974.
Apart from litigation, the author also provides advisory services to Local Authorities in drafting and preparing various agreements, including joint venture agreements, concession agreements, construction agreements, sale and purchase agreements involving Local Authority assets, licensing agreements and development agreements, among others.
