    ABSTRAK

    Hakam adalah salah satu bentuk tuntutan perceraian yang mempunyai pengertian yang tersendiri. Peruntukan perundangan perceraian secara Hakam ini telah dinyatakan dalam akta/enakmen undang-undang keluarga Islam negeri-negeri di Malaysia. Kertas kerja ini bertujuan membincangkan definisi Hakam menurut perspektif Islam. Fokus perbincangan menjurus kepada konsep Hakam berdasarkan kepada al-Quran, al-Hadith dan pandangan Ulama. Perbincangan ini mengupas bidangkuasa Hakam dan proses perceraian Hakam menurut undang-undang sedia ada. Metodologi yang digunakan dalam kajian ini ialah kajian kepustakaan iaitu analisis dokumen seperti buku-buku, artikel dan enakmen yang berkaitan. Kajian ini hanya merujuk kepada undang-undang keluarga Islam di Negeri Johor. Hasil kajian mendapati bahawa terdapat dalil syarak mengenai Hakam menurut al-Quran dan Sunnah serta pandangan ulama. Terdapat juga punca bidangkuasa Hakam dan arahan amalan yang menjelaskan lebih mendalam terhadap peruntukan tersebut.

    Abstract

    Unlike claims for defamation founded on the written word (libel) or the spoken word (slander), where the law has remained settled for close to a century, there has been much ambiguity and uncertainty surrounding claims for defamation founded on conduct. In Malaysia, the foremost pronouncement on this area of law was by the Court of Appeal in Proton Parts Centre Sdn. Bhd. v. Mohamed bin Zainal and another appeal in 2009, which did very little to clarify the legal position.

    The decision of the Court of Appeal appears to depart from the common law legal position and – as decisions that followed it have shown – this area of law remains far from resolved. Simply put, there are – at present – too many questions and too few answers.

    Abstrak

    Institut Penyelidikan Perhutanan Malaysia atau lebih dikenali dengan "Forest Research Institute Malaysia" (FRIM) telah ditubuhkan pada tahun 1985 sebagai badan berkanun. Namun proses penanaman pokok asal di FRIM telah berlaku hampir sedekad yang lalu dan kini dianggap sebagai hutan buatan manusia tertua didunia. FRIM telah diisytiharkan sebagai Tapak Warisan Semula Jadi Negara pada tahun 2010 dan diiktiraf sebagai Tapak Warisan Kebangsaan pada 2012. Sebagai kawasan hulu tadahan air yang berasal dari Bukit Lagong, FRIM mempunyai bekalan sumber air bersih yang bukan sahaja merupakan sumber air mentah untuk kegunaan domestik bagi komuniti FRIM tetapi juga menyokong ekosistem hiliran Sungai Kroh. Sumber air ini juga boleh dimanfaatkan untuk kolam-kolam air yang terdapat di FRIM bagi memastikan aliran air berterusan dalam usaha memelihara ekosistem yang sihat.

    Ladder clauses have become an essential part of restraint of trade clauses in Australia. However, significant policy concerns with the use of these clauses bring into question their continued acceptance, particularly in contracts for employment. Recent decisions concerning restraints of trade and ladder clauses suggest that the courts' patience with clauses of this kind may be waning.


    Restraint of trade clauses are a staple inclusion in many employment contracts, and for good reason. Employers have a legitimate interest in protecting their confidential information,[1] maintaining customer relationships[2] and preserving a stable and trained workforce.[3] In fact, one academic suggests that restraint of trade clauses are so essential to the preservation of an employer’s interests that any ‘lawyer who fails to advise on and draft an enforceable clause may well be considered negligent.’[4] However, for a clause that has such a ubiquitous presence in employment contracts, it is remarkable that their enforceability is so uncertain in any given circumstance.
