LEGAL ASPECT OF CHARITIES IN MALAYSIA*

    Apnizan Abdullah

Charitable giving is indeed a universal phenomenon that is highly encouraged by all religions subject to specified rules or customs.[1] Its impact on socio-economic conditions of society is undeniable. In Malaysia, the laws governing charities are piecemeal. There are charities that fall within the jurisdiction of the federal government, while others are exclusively in the hands of the states. Article 74 of the Constitution clearly creates the segregation of the legislative powers of the Federal and State Governments. The Ninth Schedule of the Constitution further spells out the demarcation of such powers, namely, the Federal Legislature is empowered to enact laws for the matters listed in List I (Federal List) and List III (Concurrent List) of the Ninth Schedule. The State Legislature is granted the power to make laws in relation to matters listed in List II and List III, subject to the restrictions imposed by the Constitution.

AN EXAMINATION OF THE LEGISLATIVE INTERVENTION IN THE
    CONTROL OF ENVIRONMENTAL POLLUTION:
    A MEASURE FOR SUSTAINABLE DEVELOPMENT

    James Emokhai Uzualu[i]
    James P. Friday[ii]
    Akande Omowonuola Dorcas[iii]

    Abstract

One of the major causes of setback in the environment is the inability to control pollution, which tends to destroy the growth of the society. The environment is our home, where we have everything that contributes to our existence. The environment includes all living and non-living things in their habitat. The thrust of this paper seeks to address the factors of pollution. Pollution has threatened human existence since time immemorial and has further prompted scholars in their intellectual capacity to reach out for solutions to address this societal plague.
